Always Going

The December edition of the hotline (which you’re reading) always recaps key events from the previous year. It’s an opportunity to reflect on the past so we can learn from shortcomings and build on success.

Reading these “end of year” editions – including the final two Dispatch newsletters of December, which recapped top stories from the general media and ARSA’s website – makes the association’s work feel cyclical. We wind down one 12-month period and start up another. In reality, it’s constant. We observe the turning over of the calendar, but the attention of the association’s team and its board is always tuned to the needs of the industry.

I invite you to walk through the most important hotline stories from 2022 below; they follow a few “live” updates from December. As you do so, consider how ARSA’s work is ongoing. Use this review to refocus on what will continue in the new year, what new opportunities will arise, and what we will do about them together.

Each story will take you to the hotline edition in which it originally appeared, so be sure to check ARSA.org for updates on issues you find particularly important. EASA Documentation for SMS Transition

In November, the European Union Aviation Safety Agency (EASA) made public a series of resources for EASA Part 145 maintenance organizations implementing new safety management systems (SMS) requirements. The new requirements became effective on Dec. 2 and apply to holders of EASA Part 145 approvals not subject to a bilateral agreement.  Maintenance organizations in the United States, Canada and Brazil will continue to comply with the current bilateral aviation safety agreements and their corresponding maintenance implementation or guidance procedures.

According to a Nov. 11 letter from the agency, approval holders should refer to its documentation index for updated guidance material. The new requirements allow for a two year transition phase, giving approval holders until Dec. 2, 2024 to fully comply with European Commission Implementing Regulation (EU) 2021/1963. During the SMS transition phase, compliance verification will be limited to the “Classic Part-145 requirements” of the new regulation.

In a separate letter, EASA announced the application of a “transition finding” to all approval holders. The letter explained the “finding” allowed each organization “to maintain its approval valid [sic] even if not in compliance with the novelties introduced by the Part-145 regulation, providing the necessary time to concentrate on the implementation of the SMS change without undue pressure.”

To support approval holders during the transition, EASA has published SMS assessment guidance and a matrix for transition phase regulatory compliance. The matrix covers every section of EASA Part 145, identifying “novelties” for compliance by late 2024.

Multidisciplinary Training at HELI-EXPO 2023

In early March 2023, in the lead up to the ARSA 2023 Annual Conference, ARSA’s training team will offer a multidisciplinary slate of options during HAI HELI-EXPO 2023 in Atlanta, Georgia.

Sarah MacLeod, Marshall S. Filler, and Christian Klein, executive team members of the association (and managing members of Obadal, Filler, MacLeod & Klein, P.L.C.) will lead a number of professional education courses as well as three “Rotor Safety Challenge” presentations.

Any participant who completes one of their professional education courses (which are provided on behalf of OFMK) and submits his or her completion certificate to ARSA Vice President of Operations Brett Levanto (brett.levanto@arsa.org) will be given a code to access one free hour of ARSA online training.

Drug and Alcohol Testing: From Regulatory Basics to Business Needs

March 5 – 8:00 a.m. to 12:00 p.m. EST

This course reviews the drug and alcohol testing requirements in Titles 14 (Aeronautics and Space) and 49 (Transportation) of the US Code of Federal Regulations (CFR). It also provides guidance on setting up these programs, including instruction on how safety-sensitive functions are defined as well as how to avoid many common testing program mistakes that can subject companies to enforcement action.

Know the Rules Like You Know Your Tools

March 5 – 1:00 p.m. to 5:00 p.m. EST

This session covers the FAA’s organization, authority and process for promulgating rules, then walks through the general requirements in 14 CFR to explain how its various components link together in a “regulatory chain” that must be comprehended by aviation businesses. Topics specific to maintenance include part 43 maintenance, preventive maintenance, rebuilding and alteration; part 65, subpart D mechanics (certification); part 65, subpart E repairmen (certification); and part 145 repair stations.

Regulations Affecting Aircraft Part Purchase and Sale

March 6 – 8:00 a.m. to 12:00 p.m. EST

This course reviews the civil aviation regulations in 14 CFR that impact the purchase, sale, receiving, stocking, inspection and installation of civil aviation articles for maintenance purposes. It also overviews other guidance as well as regulatory and contractual requirements that should be considered.

Public Aircraft Operations

March 6 – 1:00 p.m. to 5:00 p.m. EST

This course provides instruction on the statutory provisions and FAA guidance governing public aircraft operations. It covers the basic requirements for an aircraft to be operated as a public aircraft, what constitutes an eligible governmental function, and the practical implications of using the same aircraft to conduct both civil and public operations. It also discusses the FAA policy regarding operations conducted under contract for a government entity.

Self-Disclosure – Avoiding Self Exposure

March 7 – 11:45 a.m. to 12:45 p.m. EST

This session reviews the elements of the FAA’s self-disclosure programs and provides methods for addressing non-compliance with creating unnecessary scrutiny.

Building a Professional Relationship with the Government

March 7 – 10:30 a.m. to 11:30 a.m. EST

This session provides a road map for building a positive relationship with civil aviation authorities. It begins by describing the rules that should always be considered when engaging with aviation safety regulators, then provides instruction on how to introduce your company and maintain consistent contact — not just when there’s a problem. The session concludes by providing strategies for maintaining a professional relationship with regulators.

Best Practices in Maintenance Recordkeeping

March 7 – 9:15 a.m. to 10:15 a.m. EST

This session explores the regulatory responsibilities of creating and maintaining maintenance records. It will help participants to define:

  • Regulatory responsibilities of the operator versus the maintenance provider in creating and maintaining maintenance records
  • How obligations can be shifted by contract but not under aviation safety regulations
  • Maintenance recordkeeping regulations, the documents essential to making airworthiness determinations.

IATA, ICAO Seek ARSA Member Input on Training & Diversity

The International Air Transport Association (IATA) has requested ARSA member feedback to a new survey launched by the International Civil Aviation Organization’s Personnel Training and Licensing Panel (PTLP).

The panel was created in January 2020 and has working groups focused on aircraft automation (for pilot training), competency based training and assessment, flight simulation training devices, and diversity, equity, inclusion issues. More than 100 members and observers participate in the panel’s work, mostly from ICAO member state governments and some international trade associations, but ARSA is alone in ensuring the maintenance industry’s perspective is considered.

The survey collects industry data in areas consistent with the working groups. For maintenance organizations, the focus is on competency based training, simulation training devices, and diversity matters. The questionnaire includes 22 questions; the completion time and complexity of information needed to respond will vary by respondent and coordination may be required within the responding organization. Respondents will be given access to results based on the contact/demographic information shared.

UK Certification “Special Arrangement” Ends

On Dec. 8, the FAA and UK CAA issued a joint statement confirming the January 2023 termination of the Special Arrangement for Continuity in Aircraft Certification Projects.

“The two-year transition period and this associated Special Arrangement will end on 01 January 2023,” the agencies said. “From that date, the provisions of the Special Arrangement will no longer be available, and all validation projects must follow the processes set out in the Implementation Procedures for Airworthiness established between the UK CAA and the FAA.”

2022 in Review

Each story will take you to the hotline in which it appeared (which means readers should beware the timeliness of references and seek follow up on key issues).

Leading Off

January: The association’s Annual Conference ensures that at least once a year, the international maintenance industry can listen to and talk directly with leading aviation safety agencies. The “talk” may be through electronic and electrical pulses that few understand (thank you 5G providers), but it is available, useful, usable, and fruitful.

Collaboration Brings Results Across the Globe

April: Collaboration is “the action of working with someone to produce or create something.” In the international business of aviation, collaboration with many is needed to produce or create useful results.

June: Think about your favorite things. Whether it’s a shop or snack item, breakfast cereal or television show…even a trade association…you had to be introduced to it.

ARSA Works

FAA Announces New Part 147 at ARSA Conference

March: During his keynote address on March 10, FAA Associate Administrator for Aviation Safety Billy Nolen — who has since become acting administrator — announced significant progress in the decades-long trial of updating 14 CFR part 147, Aviation Maintenance Technician Schools.

ARSA Continues Press on Parts Documentation

June: On June 10, ARSA responded to the FAA’s reversal of its 2016 acceptance of the association’s E100 Form as a means of compliance with parts documentation requirements under the privileges of part 43 for the U.S./EU Maintenance Annex Guidance (MAG).

Working Group Instructs FAA on Handling Multiple Locations

July: Last month, the FAA’s Aviation Rulemaking Advisory Committee accepted a special report from the ARSA co-chaired Part 145 Working Group on the ability of a repair station to work from multiple locations under a single quality system.

ARSA’s Work is Yours

August: The association will take a position on broad, complicated issues and hold fast for the good of all.

EASA Briefs on SMS for Non-Bilateral Foreign Repair Stations

September: On Sept. 19, EASA hosted a webinar to explain its new safety management system requirements for EASA-approved Part-145 organizations outside the European Union in countries without a bilateral agreement.

Measuring Progress at Fall Roundtables

October: On Oct. 13, ARSA hosted its annual Leadership Roundtable sessions in Washington, D.C. Each year, the association focuses the attention of its board of directors — in town for its annual meeting the following day — on the issues most important to aviation stakeholders from across the regulatory chain.

UK Approval Applications Open in January

November: On Nov. 15, the FAA hosted a webinar on the Maintenance Implementation Procedures and Maintenance Agreement Guidance established between the United Kingdom and United States.

March: Focusing on one portion of the global discussion contained in the “Opening Salvo” panel held during the Symposium portion of the 2022 Annual Conference. Layman Lawyer — Pulling the Cord

April: On April 14, ARSA commented on an airworthiness directive issued by the FAA against certain MARS A.S. emergency parachutes. The association questioned the agency’s authority to issue such an AD and requested its withdrawal.

June: Don’t assume FAA inspectors are right and you are wrong.

Layman Lawyer — Government Agency

August: As part of the U.S. Executive Branch, the FAA holds broad discretion in executing its functions. ARSA members should close out this series on the agency’s Compliance Program by considering what this latitude means to them.

Emergency Certificate Actions

October: Continuing a series on the enforcement powers of the FAA and how certificate holders can manage them, this installment walks through the when, why, how and “what do you do now” of emergency certificate actions.


ARSA on the Hill

ARSA, Allies Object to Anti-Repair Station Bill

May: In a letter sent May 27, ARSA and nine other leading aviation trade associations told the bipartisan leadership of the U.S. House Transportation & Infrastructure Committee to “just say no” to the Safe Aircraft Maintenance Standards Act.

From Horrible to Better

June: The repair station bill that emerged from the House Transportation & Infrastructure Committee in June may not be “policymaking at its best,” but ARSA’s impact on the process helped make it a heck of a lot better than it could have been (and the work’s not done).

Softening SAMSA

September: In September, the U.S. House passed a significantly amended version of Rep. DeFazio’s anti-repair station bill. Despite considerable improvement, ARSA considers the bill a solution in search of a problem.


Training & Career Development

Out of the Blade Shop and Into the Future

January: In January, ARSA helped an Embry Riddle student in Daytona Beach, Florida obtain industry speakers for the school’s Society of Aerospace Technicians. John Brennan, general manager of ARSA member Aviation Blade Services in Kissimmee, volunteered to share his experience and insight related to employment and career development with the group.

The Nuts & Bolts of Giving Back

January: At the end of 2021, a group of aviation leaders personally invested in the future of the industry. After the Wings Club lost a scholarship sponsor, several past “Nuts and Bolts Award” winners — including ARSA Executive Director Sarah MacLeod — stepped up.

Runways to Good Jobs at ACTE Event

March: On March 23, ARSA Vice President of Operations Brett Levanto addressed participants at the National Policy Seminar of the Association for Career and Technical Education. ACTE represents organizations and individuals actively engaged in providing hands-on and skills-based education pathways, including schools, workforce investment bodies, educators and administrators.

Georgia on My Career-development Mind

June: ARSA Corporate Enterprise Member Chromalloy reports from the Peach State: The Georgia Rural Collaborative Coalition met on June 21 to discuss the vital connection between education and career readiness in rural communities. Active participation in the Georgia effort (or seeking our similar state-wide opportunities elsewhere) places maintenance providers at the forefront of hiring these students once they have been credentialed.

Youth Task Force Wraps with ‘Can’t Wait’ Message

September: On Sept. 22, the FAA-managed Youth Access to American Jobs in Aviation Task Force held its final public meeting. The body closed its two-year run by delivering its congressionally mandated report and handing government and industry a checklist for improving aviation career opportunities.

Scaffolding for Career Building

November: ARSA follows its own advice: Learning from colleagues at the Aircraft Electronics Association to help translate AEA’s Apprentice Program into a resource for growing careers anywhere in aviation maintenance.


Membership

ARSA Doubly Recognizes Latimer’s Impact

March: On March 10, ARSA bestowed its oldest and newest honors on long-time association volunteer leader David Latimer, HAECO Americas vice president of regulatory compliance. Retiring after decades in service to the aviation maintenance industry, Latimer earned ARSA’s Leo Weston Award for Excellence in Service to Aviation Safety as well as the first official Executive Director’s “Golden Shovel” award.

McHugh Brings New Perspective to ARSA Board

April: On April 20, the ARSA board of directors elected Alison McHugh, vice president of safety and quality at FEAM AERO, to fill the vacant seat previously held by the late Gary Hudnall.

ARSA Survey — Workforce Remains Top Concern

May: ARSA’s 2022 member survey paints a picture of an industry slowly recovering from the pandemic but still suffering a severe labor shortage.

Don’t Take ARSA’s Word for It — Member Feedback

June: Occasionally, the association’s team shares evidence of its impact on those who depend on ARSA as an “insurance policy” against an uncertain world.

Krotec Brings Cross-Disciplinary Experience to ARSA Leadership

October: During its annual board meeting on Oct. 14, the ARSA board of directors elected Josh Krotec to serve as its 2023 president. Krotec is senior vice president of First Aviation Services and has been engaged in the association’s volunteer leadership for several years, serving as government affairs chairman before his election to the board in 2019.


A Member Asked…

Fabrication?

April: My question continues an ongoing discussion of § 21.9(a)(6): “Fabrication by an appropriately rated certificate holder with a quality system, and consumed in the repair or alteration of a product or article in accordance with part 43.”

Sufficient Inspectors?

August: According the § 145.153(a) a certificated repair station must “ensure it has sufficient number of supervisors to direct…work performed.” What’s considered sufficient/insufficient, how is that measured?

D&A Testing for Receiving?

September: In reviewing § 120.215 of covered employees. It is not clear to me if someone performing the receiving inspection function has to be tested under the D&A program.

ARSA’s Political Action Committee helps elect congressional candidates who share ARSA’s commitment to better regulation and a strong aviation maintenance sector.  But ARSA is prohibited from sending PAC information to members who haven’t opted in to receive it.

The FAA Enforcement Process

There are several reasons the agency may open an enforcement investigative report (EIR). Complaints from former or current employees, routine surveillance of your operations or a problem from a customer are all examples of how an “investigation” starts.
